Dugaan Korupsi Dana Pengawasan Inspektorat Kepulauan Sula yang diduga melibatkan Inspektur Kamarudin Mahdi akan dihentikan. Hasil Audit BPKP Maluku Utara dikabarkan sudah keluar. Terduga Pelaku sudah mengembalikan dan menyetor uang ke kas daerah. Bisakah tindak pidana korupsi dan atau penggelapan gugur jika pelaku mengembalikan uang? Bolehkah sebelum gelar perkara polisi sudah memastikan penghentian penyidikan?
JScom, KEPULAUAN SULA – Proses penyelidikan Kasus Dugaan Korupsi Dana Pengawasan senilai Rp. 1,1 miliar pada kantor Inspektorat Kepulauan Sula, belakangan disebut sebagai Dugaan Penggelapan. Kasat Reskrim Polres Kepulauan Sula IPTU Rinaldi Anwar sduda agendakan Gelar Perkara Penghentian Penyelidikan.
Hal ini, “diumumkan” Rinaldi, Selasa (20/08) pekan lalu kepada media. Sebagaimana dirilis https://www.linksatu.com/post/penyelidikan-kasus-dugaan-penggelapan-dana-pengawasan-di-sula-akan-dihentikan. Dugaan Tindask Pidana Korupsi ini sudah ditangani pihak Reskrim Kepulauan Sula sejak bulan Juni 2023.
“Dalam waktu dekat dari tipikor polres sula akan melakukan gelar perkara untuk penghentian penyelidikan Kasus tersebut,” kata IPTU Rinaldi Anwar Kasat Reskrim Polres Sula, Selasa (20/08/2024). Penanganan Dugaan pidana ini terbilang lama, karena Sat Reskrim Polres Sula menunggu hasil audit BPKP.
“Jadi kenapa lama, karna kita memang menunggu hasil audit dari BPKP. Karena hasilnya sudah keluar, jadi penyidik sudah bisa mengambil sikap untuk penghentian kasusnya, ditambah hasil temuannya sudah dilakukan pengembalian serta penyetoran langsung ke kas daerah melalui Bank Maluku Malut,” ujar Rinaldi kepada wartawan linksatu.com.
Bisakah tindak pidana korupsi dan atau penggelapan gugur jika pelaku mengembalikan uang?
Portal resmi hukumonline.com mengabarkan relevansi pengembalian uang dengan dugaan tindakan korupsi. Sebagaimana dalam pasal 4 UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (“UU 31/1999”) serta penjelasannya. Dinyatakan antara lain bahwa pengembalian kerugian keuangan negara atau perekonomian negara tidak menghapuskan dipidananya pelaku tindak pidana korupsi sebagaimana dimaksud pasal 2 dan pasal 3 UU tersebut.
Kemudian, di dalam penjelasan pasal 4 UU 31/1999 dijelaskan “Dalam hal pelaku tindak pidana korupsi sebagaimana dimaksud dalam Pasal 2 dan pasal 3 telah memenuhi unsur-unsur pasal dimaksud, maka pengembalian kerugian keuangan negara atau perekonomian negara, tidak menghapuskan pidana terhadap pelaku tindak pidana tersebut.
Indikasi korupsi dana pengawasan di Inspektoprat Kabupaten Kepulauan Sula ini, polisi menyebutnya sebagai Dugaan Penggelapan. Kasat Serse IPTU Rinaldi Anwar belum menjelaskan dugaan penggelapan yang dimaksud. Sebab hal ini sangat berbeda dengan sikap sejumlah massa yang menyebutnya sebagai Dugaan Tindakan Korupsi, apalagi sebelum gelar perkara, Kasatserse suda umumkan dugaan kasus ini akan dihentikan.
Kapolres Kepulauan Sula kepada www.jurnalswara.com mengatakan perkara tersebut saat ini dalam tahap Penyelidikan. Rencana kedepannya hasil penyelidikan tersebut akan dilakukan gelar perkara tahap Penyelidikan berdasarkan hasil Penyelidikan untuk menentukan tindak lanjut terhadap penanganan Perkara tersebut kedepan.
