BUKAN hanya publik, Megawati Soekarnoputri pun berharap fajar keadilan menyingsing di Mahkamah Konstitusi (MK). Boleh jadi karena itu ia memilih “sembunyi” dari hiruk-pikuk diskusi publik tentang dugaan kecurangan Pemilihan Presiden (Pilpres) 2024 yang kini ditangani MK. Megawati mengemukakan pandangan dan harapannya atas hakim yang sedang mengadili sengketa pilpres.
Menariknya, pandangan tersebut ditulis dalam artikel berjudul “Kenegarawanan Hakim Mahkamah Konstitusi” (Kompas.id, 08/04/2024). Bukan disampaikan melalui pidato, konferensi pers, atau wawancara khusus yang bisa diliput banyak media massa. Saya menduga agar pesannya sampai secara utuh, tak terpotong-potong, terutama kepada hakim MK. Di samping itu, dikemukakan sebagai “seorang warna negara Indonesia”, bukan sebagai pemimpin Partai Demokrasi Indonesia Perjuangan (PDIP), partai politik (parpol) peraih suara terbanyak tiga kali pemilu berturut-turut, tapi capres-cawapres jagoannya kalah telak pada Pilpres 2024.
Pandangan itu merupakan sikap pribadi yang disuarakan sebagai bagian dari “amicus curiae” (sahabat pengadilan). Sebagaimana “amicus curiae” yang juga disuarakan oleh para profesor dari sejumlah kampus, budayawan/seniman, dan berbagai kalangan lain kepada hakim MK beberapa waktu lalu. Tak mewakili sikap parpol yang dipimpinnya.
Namun, tetap saja memiliki daya pengaruh, karena disuarakan oleh pemimpin parpol terbesar. Saya mengamini pandangan Megawati tersebut. Apakah fajar keadilan akan menyingsing di MK, ataukan MK membiarkan praktik elektoral penuh aroma penyalahgunaan kekuasaan (abuse of power) dalam sejarah demokrasi Indonesia? Inilah pertanyaan pokok artikel tersebut.
Saya kira juga menjadi pertanyaan pokok sebagian publik Indonesia. Kenegarawanan MK sedang mengadili sengketa Pilpres 2024. Baik pasangan 01 (Anies-Muhaimin) maupun pasangan 03 (Ganjar-Mahfud) sama-sama menggugat hasil pilpres yang dimenangkan pasangan 02 (Prabowo-Gibran) di MK. Keduanya mendalilkan hal yang kurang lebih sama, bahwa Pilpres 2024 dipenuhi kecurangan dan pelanggaran serta penyalahgunaan kekuasaan oleh presiden.
Hasil pilpres dan dalil gugatan pasangan 01 dan 03 sebenarnya tak meleset dari perbincangan publik sebelum pilpres digelar. Aroma kecurangan, pelanggaran, dan penyalahgunaan kekuasaan oleh presiden pada Pilpres 2024 sudah tercium pascaterbitnya putusan MK Nomor 90/PUU-XXI/2023 yang sangat kontroversial.
Putusan MK itu menjadi sandaran hukum bagi pasangan Prabowo-Gibran mendaftar di Komisi Pemilihan Umum (KPU), meski Gibran belum memenuhi syarat usia. Putusan itu dikecam oleh banyak kalangan. Megawati pun mengecamnya. Dinilai menabrak aturan, melanggar kepatutan (moralitas), dan melecehkan nalar publik. Isu korupsi, kolusi dan nepotisme (KKN) serta politik dinasti yang dikaitkan dengan kekuasaan Orde Baru kembali menjadi perhatian publik.
Pasalnya, Gibran adalah putra sulung Presiden Joko Widodo. Putusan MK Nomor 90 itu juga berakibat pada sejumlah hakim MK dijatuhi hukuman etik. Bahkan, Anwar Usman, paman Gibran, diberhentikan dari jabatan ketua MK. Putusan itu juga merembet pada pemberian sanksi etik oleh DKPP (Dewan Kehormatan Pengelenggara Pemilu) kepada anggota KPU. DKPP menilai pelanggaran etik terbukti dilakukan komisioner KPU, karena tidak mengindahkan kode etik dan pedoman perilaku penyelenggara pemilu dengan tidak melakukan revisi aturan prosedur terkait syarat calon presiden dan wakil presiden pascaterbitnya putusan Nomor 90 tersebut.
DKPP menjatuhkan sanksi berupa peringatan keras terakhir kepada Ketua KPU. Enam komisioner lainnya dikenakan sanksi peringatan keras. Semua itu menjadi residu Pilpres 2024 yang tentu saja menurunkan derajat legitimasinya. Bahkan, menjadi materi gugatan di MK. Sidang sengketa Pilpres 2024 telah digelar di MK. Publik dapat mengikutinya secara langsung.
Memang lebih seru dibandingkan dengan sidang sengketa pilpres sebelumnya. Setidaknya ada empat pejabat kelas menteri yang dihadirkan oleh MK, yang sebelumnya tak pernah terjadi. Meski paparan para menteri terkesan normatif dan hanya para hakim yang diberi kesempatan bertanya, setidaknya menumbuhkan harapan fajar keadilan akan menyingsing di MK. Dan, kini bola di tangan para hakim MK. Karena itu, sudah sepatutnya publik mendorong dengan segala hormat kepada hakim MK untuk menggunakan “keistimewaan” jabatannya.
Hakim konstitusi bukan jabatan sembarangan dan diisi sembarangan orang. Di samping disumpah atas nama Tuhan, syarat-syarat hakim konstitusi diatur di dalam UUD 1945. Salah satu syarat yang ditegaskan dalam UUD 1945, seorang hakim konstitusi adalah seorang negarawan yang menguasai konstitusi dan ketatanegaraan. Istimewa sekali, karena syarat kenegarawanan tidak ditentukan untuk jabatan kenegaraan lain dalam UUD 1945.
Syarat presiden pun tak menyebut eksplisit seorang negarawan. Tentu saja hakim konstitusi adalah orang-orang istimewa yang melampaui jabatan kenegaraan yang lain, yang boleh dikata “telah selesai dengan urusan diri sendiri”. Kenegarawanan mengandung muatan-muatan normatif yang tidak bisa begitu saja disamakan dengan kualitas seorang politikus. Di negara demokrasi, semua warga negara berhak menjadi politikus, tetapi tidak semua politikus memiliki kualifikasi negarawan. Kepentingan-kepentingan pragmatis adalah keniscayaan di dalam politik demokrasi. Namun, di dalam demokrasi juga tidak dibutakan oleh kepentingan kekuasaan semata yang cenderung pragmatis.
Di sanalah kenegarawanan dibutuhkan. Kualitas tertentu yang tidak dapat dilepaskan dari keutamaan-keutamaan moral yang dimiliki seseorang, yang membuatnya bijak dan bajik. Dan, hakim MK yang mengadili sengketa Pilpres 2024 semestinya juga berpegang teguh pada prinsip moralitas (etika), karena sesungguhnya hukum dibuat untuk memastikan nilai-nilai tentang kebaikan bersama berfungsi di masyarakat.
Historis Kualitas kenegarawanan yang dituntutkan kepada hakim MK bersifat historis. MK adalah produk historis. MK menandai babak baru sejarah politik demokrasi Indonesia pasca-Orde Baru. Maka, di atas kertas keberadaan MK mestinya turut menjamin dan memastikan kualitas demokrasi Indonesia membaik dari waktu ke waktu. Kualitas demokrasi yang membaik itu bukan hanya soal tata caranya (misal soal pemilu), melainkan juga substansinya (misal soal kemerdekaan berpendapat). Karena itu, dari sudut historis tak berlebihan MK diidentikan dengan fajar keadilan itu sendiri. Sinarnya diharapkan akan menerangi kegelapan perjalanan demokrasi Indonesia.
Ke mana? Tak lain menuju tanah harapan di seberang jembatan emas proklamasi kemerdekaan Indonesia. Fajar keadilan adalah keniscayaan sejarah manusia, juga bangsa-bangsa. Bangsa Indonesia terlahir dari fajar keadilan yang menyingsing di segala penjuru Nusantara. Saya memercayai gerak sejarah yang dialektis.
Cut Nyak Dien, Diponegoro, Pattimura lahir sebagai antitesis atas praktik kolonialisme. Pun Soekarno yang berteriak “Indonesia Menggugat” di depan hakim kolonial di Bandung pada 1930. Mereka adalah fajar keadilan pada zamannya. Serupa pula dengan Ratu Adil yang menggerakkan pemberontakan rakyat petani pada abad ke-18 dan ke-19.
Maka, seperti kata Megawati di artikel tersebut, tidak ada kekuatan yang bisa menghalangi fajar menyingsing di ufuk timur. Dalam gerak alam raya disebut “hukum alam”. Dalam gerak sejarah dinamakan “hukum sejarah”. Hanya soal waktu, cepat atau lambat, fajar itu niscaya menyingsing dengan jalannya sendiri.
Maka, keputusan hakim MK atas sengketa Pilpres 2024 sangat ditunggu rakyat Indonesia. Apakah keadilan substantif dapat benar-benar ditegakkan oleh hakim-hakim MK, atau sebaliknya para hakim semakin terseret ke dalam pusaran tarik-menarik kepentingan kekuasaan politik? Kenegarawanan para hakim MK sungguh diuji. Megawati pun diuji Tak hanya di MK, fajar keadilan sesungguhnya juga diharapkan menyingsing di Dewan Perwakilan Rakyat (DPR) dalam bentuk Hak Angket.
Banyak kalangan menilai, dengan hak konstitusionalnya itu DPR dapat mengurai carut-marut Pilpres 2024. Sebagaimana publik ketahui, hak angket berawal dari ide Ganjar Pranowo, lalu mendapatkan respons positif dari sejumlah kalangan. Namun, rupanya “layu sebelum berkembang”. Perbincangan soal hak angket menguap, tak ada kejelasan. PDIP sebagai parpol utama pengusung Ganjar tak memberikan kejelasan.
Padahal, keseriusan PDIP dinilai sebagai kunci kemungkinan fajar keadilan menyingsing di DPR melalui Hak Angket. Kita paham bahwa Hak Angket memiliki risiko politik yang tak kecil. Secara politik bisa ditendang ke mana-mana yang berakibat pada ketegangan dan kegaduhan politik. Bisa pula berujung pada pemakzulan Presiden Joko Widodo. Risiko yang sama secara politik sesungguhnya juga bisa terjadi ketika fajar keadilan menyingsing di MK, misalnya MK memutuskan pilpres ulang. Alasan putusan MK bisa saja dibawa oleh para politikus ke Senayan, dan berpotensi pada pemakzulan presiden pula.
Di sanalah Megawati Soekarnoputri pun diuji kenegarawanannya. Pada satu sisi mengharap fajar keadilan menyingsing di MK, pada sisi lain fajar keadilan itu berpotensi memproduksi ketegangan dan kegaduhan politik baru. Tak mudah bagi Megawati. PDIP sebagai parpol terbesar tentu saja memegang peran kunci dinamika politik Indonesia pascaputusan MK tentang sengketa Pilpres 2024. Apapun putusan MK akan berujung pada pengujian kenegarawanan Megawati Soekarnoputri sebagai pemimpin puncak PDIP.
Namun, melihat perjalanan politik Megawati yang terjal berliku, saya meyakini ia sebagai negarawan sejati akan mampu melampauinya. Saya meyakini Megawati memiliki cara mengelola dinamika politik yang tak mengorbankan bangsanya dan tetap menjaga integritas. Saya masih teringat betul wawancara eksklusif Rosiana Silalahi dengan Megawati dalam program ROSI yang disiarkan Kompas TV, Kamis, 8 Februari 2024.
Banyak pihak mendorong Megawati untuk bermanuver politik dengan menarik para menterinya dari pemerintahan Presiden Joko Widodo. Namun, ia memiliki sudut pandang lain yang berbasis pada aturan dan etika. Megawati dengan gamblang menjelaskan alasannya mencegah menteri-menteri dari PDIP mundur dari kabinet Presiden Joko Widodo. Ia senantiasa melihat aspek “buntungnya” untuk bangsa dan negara.
Bukan melihat aspek “untungnya” untuk diri sendiri. Ia tak mau pemerintahan goyah hanya demi kepentingan elektoral, sementara rakyat, bangsa dan negara akan menanggung akibatnya. Dan, hal itu diyakini sebagai etika yang sudah seharusnya menyemangati politik. Di artikel berjudul “Kenegarawanan Hakim Mahkamah Konstitusi”, Megawati memiliki empat pedoman sederhana yang bisa memunculkan kenegarawanan. Satu di antaranya adalah qana’ah, merasa cukup terhadap apa yang ada.
Ketika konstitusi membatasi jabatan masa presiden dua periode, itulah kebenaran yang harus ditaati. Tidak bisa diperpanjang, baik secara langsung maupun tak langsung. Saya kira, prinsip qana’ah itu juga menjadi hal penting untuk melihat realitas sosial. Ada batas realitas, dan tak bijak kita memaksakan kehendak melampaui batasnya. Harapan boleh melambung tinggi, tapi ada batasnya untuk menjadi kenyataan. Seorang negarawan harus bisa menahan diri atas kehendak dan kepentingan sendiri. Prinsip qana’ah itu, saya kira, membuat Megawati senantiasa memiliki semangat perjuangan yang tak kenal lelah dan menyerah, tapi tetap realistis. Membuat Megawati mampu pula memimpin PDIP, baik di luar pemerintahan maupun memimpin pemerintahan. Megawati tak pernah risau meski partai yang dipimpinnya di luar pemerintahan sebagai oposisi. Saya kira, Megawati akan memilih PDIP di luar pemerintahan bila ternyata MK memilih jalan kegelapan demokrasi, menolak fajar keadilan menyingsing di sana. Prinsip yang patut dipedomani pula oleh hakim-hakim MK dan para pemimpin Indonesia yang ingin melihat masa depan demokrasi Indonesia gilang-gemilang. (Sandro GATRA)
